Terms and Conditions

These terms are an agreement between you and Next Generation Design Ark (“we”, “us”) for your use of Next Generation Design Ark, the website at ngdesignark.com and the apps and services we offer there (the “Service”). By creating an account, buying a plan or credits, or otherwise using the Service, you agree to these terms. If you use the Service for a company or other organization, you agree on its behalf and confirm you are allowed to.

1. The Service

Next Generation Design Ark is a browser-based tool for designing homes and interiors. You can draw floor plans or start from a drawing, sketch or photo, see the design as a 3D model, furnish it, ask an AI assistant for changes, render images and videos, and share designs through links.

We may change, add or remove features over time. If we remove a feature that is a main part of a paid plan, we will tell you in advance where we reasonably can.

2. Your account

• You must be at least 18 years old, or the age of majority where you live, to create an account.
• Give us accurate information and keep your sign-in email and any linked Google account secure.
• You are responsible for everything done through your account. Tell us at support@ngdesignark.com if you think someone else has used it.

3. Plans, credits and payments

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. When you buy, you also agree to Paddle’s Buyer Terms. Paddle collects payment, charges any sales tax or VAT, and sends your receipts.

Subscriptions

• The Starter plan is free. Paid plans are billed monthly or yearly, in advance, at the price shown when you subscribe.
• Subscriptions renew automatically at the end of each billing period until you cancel. You can cancel at any time from Account → Manage billing; your plan stays active until the end of the period you have paid for.
• If you switch plans, the change applies straight away and Paddle charges or credits the difference for the rest of the billing period.
• We may change plan prices. We will tell you at least 30 days before a new price applies to your subscription, and you can cancel before it does.
• If a payment fails, Paddle will retry it. If it still cannot be collected, we may move your account to the Starter plan.

Credits

• Some features, such as renders and AI generation, use credits. The cost of an action is shown before you start it.
• Paid plans include a monthly credit allowance. It refills each month from the date your plan started, including on yearly plans, and unused allowance does not carry over to the next month.
• Credits you buy as a pack do not expire while your account is open.
• Credits have no cash value, cannot be transferred or exchanged for money, and are not refundable once used.

Refunds

Paddle handles refunds. To ask for one, reply to your Paddle receipt, use paddle.net, or email us at support@ngdesignark.com. This does not affect any rights to a refund or cancellation you have under the law where you live.

4. Your content

“Your content” means the designs, plans, drawings, photos, logos, 3D models, videos, messages and voice notes you create or upload. You keep ownership of your content.

• You give us a worldwide, non-exclusive license to host, copy, process, render and display your content only as needed to run the Service for you. This includes sending it to the service providers listed in our Privacy Policy, such as AI providers, when you use features that need them.
• When you share a design through a link, or publish it to the public showcase, anyone with the link (or anyone, for the showcase) can see what you shared. You can turn sharing off at any time.
• You confirm you have the rights to everything you upload, including logos, photos, floor plans and furniture models, and that your content does not infringe anyone else’s rights.
• If you collect enquiries or other details from people who view your shared links, you are responsible for using that information lawfully and for any notices or consents the law requires.

5. AI features and designs

The Service uses AI to suggest changes, generate furniture, models and textures, read plans and photos, transcribe speech and narrate tours. AI output can be wrong or incomplete, and similar requests from other users may produce similar results. Review what the Service produces before you rely on it.

Designs, measurements and renders made with the Service are visualizations. They are not construction drawings or professional architectural, engineering, structural or legal advice. Check dimensions, structure, building regulations and permits with qualified professionals before you build or buy anything based on them.

6. Third-party content and services

Some furniture and models come from third parties such as Sketchfab, under their own licenses. When you use them, you must follow those licenses, including any credit or non-commercial terms. Linking an outside account, such as Google or Sketchfab, is also subject to that provider’s terms.

7. Acceptable use

You agree not to:

• break the law, or infringe anyone’s intellectual property, privacy or other rights;
• upload content that is unlawful, hateful, harassing, sexually explicit or deceptive, or that contains malware;
• use shared links or the showcase to mislead people, for example about a property you do not have the right to market;
• try to get around plan limits, credit charges or security, or access accounts or data that are not yours;
• overload, scrape, reverse engineer or resell the Service, or use it to build a competing product;
• use automated means to create accounts or generate content in bulk.

8. Suspension and ending your account

You can stop using the Service at any time. To close your account and delete its data, cancel any subscription and email support@ngdesignark.com from the address you sign in with.

We may suspend or close an account that breaks these terms, puts other users or the Service at risk, or that we must close by law. Where it is reasonable, we will tell you first and give you a chance to fix the problem or download your work. If we close your account without cause, we will refund the unused part of any prepaid subscription.

9. Disclaimers

We work to keep the Service available and reliable, but it is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Service will be uninterrupted or error-free, or that AI output will be accurate. Keep your own copies of important work.

10. Limitation of liability

To the extent the law allows, Next Generation Design Ark will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim about the Service is limited to the greater of the amount you paid for the Service in the 12 months before the claim arose, or US$100.

Some places do not allow these limits, so they may not all apply to you.

11. Indemnity

You agree to cover our reasonable costs, including legal fees, from claims by third parties that arise from your content or from your breach of these terms.

12. Governing law

These terms are governed by the laws of the United States and of the state in which Next Generation Design Ark is organized, without regard to conflict-of-law rules. If you are a consumer, you keep the protection of the mandatory laws of the place where you live.

13. Changes to these terms

We may update these terms. We will post the new version here with a new date, and for significant changes we will tell you by email or in the app at least 14 days before they take effect. If you keep using the Service after that, you accept the new terms. If you do not agree, you can cancel and stop using the Service.
